A federal court in Minnesota denied a motion for partial judgment on the pleadings brought by United HealthCare in its antitrust action against a pharmaceutical company. The court ruled that a motion for judgment is “not the ‘correct vehicle’” for challenging the affirmative defenses raised by the pharmaceutical company; United HealthCare did not move for judgment on the claims.

A federal court in Illinois denied a motion for judgment on the pleadings concerning negligence claims against two landlords whose adjoining building lacked running water when a tenant allegedly ignited a fire that spread into a neighboring restaurant. The restaurant owner plausibly alleged that the landlords created a foreseeable fire risk by renting the building when they knew it had no water service.

An appellate court in Louisiana affirmed the trial court’s conviction of a defendant for violating protective orders. He says it is unfair to sentence him to 24 years of consecutive sentences over his single act of a phone call, but he called his victim from jail in violation of three protective orders instructing him not to. He has been convicted of 18 felonies and has been given multiple “second chances.” He poses an “unusual and undue high risk” to the public, so the sentences were not excessive.

The Louisiana Secretary of State was unable to secure a stay of proceedings in this lawsuit challenging a state law requiring proof of citizenship to register to vote. State officials have not shown that considerations of “hardship and inequity” and “judicial economy” favor a stay. Voting rights groups, on the other hand, have shown that a stay would run against their interests and limit the ability of the court to intervene later, close to an election.

An Illinois federal court allowed portions of a man’s unlawful detention claims against county officials after detectives and prosecutors allegedly pursued him for a 2020 murder without reliable evidence, resulting in two years of jail time without probable cause and based on perjured grand jury testimony. His false arrest claims are time-barred and many of the defendants enjoy prosecutorial immunity from his complaint.

The environmentalists claim discussions for the project happened behind closed doors despite public opposition.

Kentucky residents and businesses filed a class action to hold the UPS, General Electric and Boeing liable for injury, lost business and property damage stemming from a Nov. 4 plane crash of a UPS cargo plane. At least 12 people were killed in the crash.
